Agreement to Terms

By downloading, installing, or using the 1% Better mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

                Summary: By using 1% Better, you agree to these rules designed to keep everyone's experience positive.
            

Description of Service

1% Better is a habit tracking app that helps you build sustainable habits through:

Creating and tracking daily, weekly, or monthly habits
Visual progress tracking with streaks and rewards
AI-powered coaching and personalized suggestions
Push notification reminders for your habits
Progress analytics and milestone celebrations

What We Do With Your Data

Plain English Summary:

✅ Your habits, check-ins, and profile are stored securely in our database
✅ AI chat messages are sent to OpenAI to generate responses
✅ Push notification tokens are used only to send you reminders
✅ Payment processing is handled entirely by Apple/Google — we never see your card
❌ We do NOT sell your data to anyone
❌ We do NOT use tracking or advertising SDKs
❌ We do NOT share your data except as needed to run the app

You're responsible for all activity under your account

Subscription Terms (Auto-Renewable)

                Apple App Store Required Disclosure: Payment will be charged to your Apple ID account at confirmation of purchase. Subscription automatically renews unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

Monthly: $3.99 USD/month
Yearly: $29.99 USD/year (save 37%)

Payment & Billing

Payment charged to your Apple ID or Google Play account at purchase confirmation
Processed exclusively through App Store or Play Store
We do NOT receive your payment card details

Auto-Renewal

                Important: Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends. Your account will be charged within 24 hours prior to expiration.
            

How to Cancel

iOS: Settings → [Your Name] → Subscriptions → 1% Better → Cancel
Android: Play Store → Menu → Subscriptions → 1% Better → Cancel

Cancellation takes effect at the end of the billing period. You keep premium until then.

                Note: Deleting the app does NOT cancel your subscription. Cancel through your device's app store settings.
            

Refunds

Refund requests must be made through Apple App Store or Google Play Store per their policies.

Account Deletion

Per Apple App Store Guidelines (5.1.1), you can delete your account:

In-App: Profile → Scroll to bottom → Delete Account

Deletion is permanent. Active subscriptions must be cancelled separately.

Acceptable Use

You agree NOT to:

Violate any laws or regulations
Attempt unauthorized access to the service or accounts
Upload malicious code or harmful content
Interfere with or disrupt the service
Reverse engineer the App
Use bots or automated systems
Harass or abuse others
Create multiple accounts to bypass limits

AI Coach Feature

By using AI Coach, you understand and agree:

Third-Party Processing: Your messages are sent to OpenAI (GPT-4o-mini model) for processing
API Logging Disabled: OpenAI does not use your data to train models or retain messages beyond processing
Data Shared: Chat messages plus habit context (name, category, streak data, recent mood)
Local Storage: Last 50 messages stored on your device and sent with each request to maintain conversation context
Usage Limits: Free users: 30 AI messages per month. Premium: Unlimited
AI responses are automated and may not always be accurate or appropriate
AI is for informational and motivational purposes only
AI does NOT provide medical, psychological, or professional health advice

Push Notifications

Per Apple Guidelines (4.5.4):

Notifications are optional and require your consent
Used only for habit reminders and important updates
Not used for marketing without consent
Can be disabled in app or device settings

Intellectual Property

All content, features, and functionality of 1% Better are owned by us and protected by intellectual property laws. You retain ownership of your created content and grant us a limited license to provide the service.

Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR REQUIREMENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount paid in the preceding 12 months, or $50 USD, whichever is greater.

Indemnification

You agree to indemnify us from claims arising from your use of the App, violation of these Terms, or violation of third-party rights.

Termination

We may suspend or terminate accounts for Terms violations. You may terminate by deleting your account. Termination does not automatically cancel active subscriptions.

Governing Law

These Terms are governed by applicable laws. Disputes shall first be attempted through negotiation.

Changes to Terms

We'll notify you of significant changes via in-app notification and updated "Last Updated" date. Continued use constitutes acceptance.

Severability

If any provision is unenforceable, it shall be modified minimally, and remaining provisions continue in effect.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement.
